About
Mr. Foley’s practice concentrates primarily on
Family Law, with a focus on high conflict cases and those with significant
property at issue. Over the course of his practice, Mr. Foley
has developed a wealth of practical experience and insight into the
emotional, psychological and financial aspects of settling complex custody,
parenting time, spousal support and property issues. Mr. Foley is committed
to helping men and women resolve their Family Law related issues in a fair
and honorable manner, avoiding when possible the emotionally destructive and
financially debilitating consequences of litigation.
In addition to representing individual
clients, Mr. Foley has served as both a mediator and an arbitrator since
1995. He is widely known for his ability to bring complex and
contentious cases to resolution through his alternative dispute resolution
practice. Mr. Foley has been a part of family law mediation in
this region since its beginnings, when he served as a volunteer mediator in
the Wayne County Circuit Family Court mediation pilot project at the
invitation of the Honorable William Callahan.
Despite his commitments, Mr. Foley still
provides pro bono legal services on referral from religious leaders,
including priests and imams, in the Dearborn area. He is a past member of
the Wayne County Bench/Bar Committee and has served by invitation as a
mediator for the Michigan Court of Appeals in Family Law cases.
Representative matters include:

Skelly v. Skelly, 286 Mich. App 578 (2009)
·
Following a 6+ day trial, obtained an Order granting sole
legal and physical custody of three minor children to client after over a
year of parental alienation.
·
Following a 20+ day trial, obtained an Order granting sole
legal and physical custody of daughter to client following unfounded
allegations and parental alienation by the other parent. The other parent
was granted limited supervised parenting time.
·
Obtained an Order allowing client to change domicile to the
State of Texas, over the objections of the other parent.
·
Successfully negotiated the terms of a consent order providing
that opposing part dismiss a motion to change domicile to the State of Michigan, and providing client with physical custody of
the minor child and summer parenting time to the opposing party.
·
Following 3+ day trial, obtained a Judgment of Custody
granting sole legal and physical custody of minor son to client, with
supervised parenting time to other parent.
·
Obtained an Order of Filiation, Paternity and Judgment of
Custody granting sole legal and physical custody of minor son to client
with limited parenting time to other parent.
·
Successfully entered a Judgment granting substantial assets to
client and stopping the opposing party's attempt to bleed the marital
estate of any funds.
·
Successfully negotiated the terms of a Judgment of Divorce
awarding joint legal custody and week-on/week-off parenting time to each
party.
·
Negotiated terms of a Consent Judgment where our client
received 100% of his business, the marital home, 100% of his retirement and
his other property. Wife received a
lump sum payment.
